Comprehensive conditions, rights, obligations, disclaimers, and legal protections governing PolandEduStart services.
1. General Provisions & Service Provider Information
These Terms of Service (hereinafter referred to as the "Terms") regulate the conditions of using the website PolandEduStart (polandedustart.com) and define the legal terms for contracts concluded for educational advisory, university admission support, administrative guidance, arrival packages, and digital reference publications.

By submitting an inquiry, booking a consultation, or purchasing any service package on PolandEduStart, you acknowledge having read, understood, and agreed to be legally bound by these Terms.
2. Scope of Advisory & Consulting Services
PolandEduStart offers independent professional educational consulting designed to assist international candidates in pursuing higher education in Poland:
A. Starter Consultation Package
A dedicated 1-on-1 consultation session with an admission specialist evaluating your academic profile, target universities in Poland, degree requirements, document preparation, and documentation overview. This package includes a digital student guidebook as an included reference publication.
B. Admission & administrative support Package
End-to-end guidance for university application submissions, document coordination, communication with university admissions offices, consular appointment preparation, and document verification.
C. VIP Arrival Package
Comprehensive arrival and settling-in assistance in Poland: housing search support, dormitory/apartment lease review, local address registration (*zameldowanie*), PESEL tax number application guidance, Polish bank account setup, airport greeting, and student orientation.
3. Advisory Status & Non-Representation Disclaimer
PolandEduStart is a private educational consulting firm operated by PRIMO-DOTACJE Sp. z o.o. We are not an agency of the Polish government, a diplomatic office, or a law firm.
Our advisory services and written materials constitute professional educational consulting and do not constitute formal legal representation in Polish courts or administrative proceedings unless a licensed legal counsel (*radca prawny* or *adwokat*) is separately retained under a formal power of attorney.
4. Absolute Non-Guarantee Disclaimer (University Admissions & Permits)
Contract of Diligent Effort (Umowa Starannego Działania)
Contracts concluded with PolandEduStart are contracts of diligent effort (*umowa starannego działania*), not contracts of result (*umowa rezultatu*). Specifically:
- University Decisions: Acceptance or rejection of candidate applications is decided exclusively by the independent academic boards of the respective Polish higher education institutions.
- Permit & Entry Decisions: The granting or refusal of border entry is within the exclusive sovereign jurisdiction of national diplomatic missions, ministries of foreign affairs, and border control authorities.
PolandEduStart does not issue permits or university admission certificates and cannot guarantee acceptance or permit issuance. Rejection by a university or diplomatic authority does not constitute breach of contract by PolandEduStart and does not entitle the client to a refund of advisory fees.
5. Limitation of Financial Liability & Exclusion of Damages
To the maximum extent permitted by applicable Polish and European Union law:
- Financial Liability Cap: The total aggregate financial liability of PRIMO-DOTACJE Sp. z o.o., its officers, employees, and representatives for any and all claims arising out of or related to these Terms or services rendered shall be strictly limited to the actual net amount paid by the client to PolandEduStart for the specific service package in question.
- Exclusion of Consequential Losses: PolandEduStart shall not be liable under any circumstances for indirect, incidental, special, punitive, or consequential damages, including but not limited to lost university tuition fees, missed flight costs, forfeited housing deposits, lost wages, or lost educational opportunities.
6. Force Majeure & External Disruption
PolandEduStart shall not be held liable or deemed in default for failure or delay in fulfilling service obligations if caused by events beyond our reasonable control (Force Majeure), including but not limited to:
- Diplomatic crises, war, civil unrest, or international sanctions.
- Changes in Polish migration laws (*Ustawa o cudzozidcach*) or sudden changes in consular appointment rules.
- Diplomatic office closures, strikes, epidemic/pandemic restrictions, or state-mandated travel bans.
- University admission quota cancellations or severe technical outages of public government systems (e.g. e-Konsulat or university registration portals).
7. Digital Content & Bundled Guidebook Licensing
Clients purchasing the Starter Consultation package receive a digital student guidebook as an included reference publication.
- Personal License: PolandEduStart grants the client a non-exclusive, non-transferable, personal license to read the digital guidebook.
- Copyright Protection: All content, text, templates, and graphics in the guidebook are protected by Polish Copyright Law (*Ustawa o prawie autorskim i prawach pokrewnych*). Clients may not copy, re-sell, distribute, publicize, or share the materials.
8. Client Obligations & Document Authenticity
Clients are required to provide completely accurate, truthful, and genuine documentation.
Submitting fake, altered, or forged documents (such as fake transcripts, fraudulent bank statements, or invalid language certificates) is illegal. Submitting false records will result in immediate termination of all services without refund.
The client agrees to indemnify and hold harmless PRIMO-DOTACJE Sp. z o.o. against any third-party claims, legal expenses, fines, or losses incurred due to the client submitting fraudulent information.
9. Consultation Appointments & Cancellation Policy
- Rescheduling: Clients may reschedule a consultation session up to 24 hours prior to the scheduled time without penalty.
- No-Show Policy: If a client fails to attend a scheduled consultation without giving 24 hours advance notice, the session is forfeited without refund, as specialist time was reserved.
10. Statutory Right of Withdrawal (EU Consumer Rules)
EU consumer clients have a statutory 14-day right to withdraw from a distance contract under the Polish Consumer Rights Act (*Ustawa o prawach konsumenta*).
- Immediate Digital Content: Requesting immediate electronic access or download of the digital guidebook prior to 14 days waives the right of withdrawal once delivery commences.
- Performed Services: Requesting a consultation to take place within 14 days waives the right of withdrawal once the advisory session has been conducted.
11. Fees, Taxes, & Electronic Invoices
Service prices listed on the website include applicable taxes. Payments are handled via certified payment gateways (Stripe, PayPal) or bank transfers. Electronic invoices are delivered via email in accordance with Polish VAT legislation.
12. Formal Complaints Procedure
Formal complaints regarding service delivery must be sent in writing to:
Complaints will be formally evaluated and responded to within 14 calendar days from receipt pursuant to Polish Consumer Protection rules.
13. Governing Law, Jurisdiction, & ODR Platform
These Terms are governed by the laws of the Republic of Poland. EU consumers may access the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
Judicial disputes involving commercial entities shall be submitted to the court having territorial jurisdiction over PRIMO-DOTACJE Sp. z o.o. in Poznań, Poland.
